Terms of Service

Welcome to Shabrr. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms.
1. Services
Shabrr Studio provides web development, mobile app development, and related technical services. Our services include but are not limited to:
- Landing page development - Web application development - Mobile application development (React Native) - Design and user experience services - Ongoing maintenance and support
Specific deliverables, timelines, and project scope are defined in individual project agreements or proposals.
2. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your project requirements - Respond to communications in a timely manner to avoid project delays - Provide necessary access, assets, and content required for the project - Review and provide feedback on deliverables within agreed timeframes - Make payments according to the agreed schedule - Ensure you have the rights to any content, assets, or materials you provide
3. Project Process
**Scope Definition** Before starting any project, we will agree on the scope, deliverables, timeline, and cost. Changes to scope may affect timeline and cost.
**Communication** Primary communication will be through email, WhatsApp, or project management tools. We will provide regular progress updates throughout the project.
**Revisions** Each project package includes a specified number of revision rounds. Additional revisions beyond the included amount may incur extra charges.
**Approval** You are responsible for reviewing and approving deliverables. Once approved, changes may require additional fees.
4. Payment Terms
**Quotations** All prices are quoted in USD or IDR as specified. Prices are valid for 30 days from the quote date unless otherwise stated.
**Payment Schedule** - Landing Page: Full payment before project start, unless otherwise agreed - Product Build: Typically 50% upfront, 50% upon completion - Monthly Support: Payment due at the beginning of each month
**Payment Methods** We accept payment via bank transfer and other methods as agreed. Payment details will be provided upon project confirmation.
**Late Payments** Late payments may result in project delays or suspension of services. We reserve the right to charge interest on overdue amounts.
5. Intellectual Property
**Client Materials** You retain ownership of all content, materials, and intellectual property you provide to us for the project.
**Deliverables** Upon full payment, you own the custom code and designs created specifically for your project. We retain the right to use general knowledge, skills, and experience gained during the project.
**Third-Party Components** Projects may include third-party libraries, frameworks, or tools with their own licenses. You must comply with these licenses.
**Portfolio Rights** We may display your project in our portfolio unless you request otherwise. Confidential or proprietary information will not be disclosed.
6. Confidentiality
Both parties agree to keep confidential any non-public information shared during the project. This includes business information, technical details, and project-specific information.
Confidentiality obligations do not apply to information that: - Is or becomes publicly available through no fault of the receiving party - Was already known to the receiving party before disclosure - Is independently developed without using confidential information - Must be disclosed by law
7. Warranties and Disclaimers
**Our Warranty** We warrant that our services will be performed professionally and in accordance with industry standards. We will fix bugs and issues reported within the warranty period at no additional cost.
**Disclaimer** Except as expressly stated, we provide services "as is" without warranties of any kind, either express or implied. We do not guarantee that software will be error-free or operate without interruption.
**Third-Party Services** We are not responsible for issues caused by third-party services, hosting providers, or external dependencies.
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claims arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim - We are not liable for indirect, incidental, special, consequential, or punitive damages - We are not liable for loss of profits, data, or business opportunities
This limitation applies regardless of the legal theory under which damages are sought.
9. Project Cancellation
**By Client** You may cancel a project at any time. If cancellation occurs: - Before project start: Full refund minus any non-recoverable expenses - After project start: You pay for work completed to date
**By Shabrr** We may cancel a project if: - Payment is not received according to the agreed schedule - You breach these Terms - Continuation is impractical due to circumstances beyond our control
In such cases, you will receive deliverables for work completed and paid for.
10. Support and Maintenance
**Included Support** Post-launch bug fixes are included for 1 month after project delivery for Product Build packages.
**Monthly Support** Ongoing support plans include development hours for improvements, fixes, and new features as specified in the plan.
**Exclusions** Support does not cover: - Issues caused by third-party modifications - Changes requested beyond agreed scope - Issues arising from hosting or server problems - Force majeure events
11. Term and Termination
**Term** These Terms remain in effect while you use our services and thereafter for provisions that by their nature should survive.
**Termination** Either party may terminate the service relationship: - For ongoing services: With 30 days written notice - Immediately if the other party materially breaches these Terms
**Effect of Termination** Upon termination, all outstanding payments become due. You will receive deliverables for work completed and paid for.
12. Governing Law
These Terms are governed by the laws of Indonesia. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Indonesia.
13. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
